- We do not guarantee that our Services will meet your expectations or produce any particular outcome.
- Any projections, estimates, or examples provided regarding potential results are for illustrative purposes only and do not constitute guarantees.
- Your success depends on many factors including your business, industry, marketing efforts, and external factors beyond our control.
3. Client Responsibilities
You are responsible for:
- Providing all content, images, text, and materials needed for your website ("Client Content")
- Ensuring Client Content does not infringe on any third party's intellectual property rights
- Reviewing and approving all content before publication
- Maintaining backups of your own data
4. Intellectual Property
- Upon full payment, you receive ownership of the custom website design created for you
- We retain ownership of all pre-existing tools, templates, frameworks, and processes
- You represent that you have the right to use any Client Content you provide
5. Payment Terms
- Payment schedules are outlined in each project proposal
- Work begins upon receipt of initial payment
- All payments are non-refundable once work has commenced
- Additional work outside the agreed scope will be billed at our hourly rate
6. Limitation of Liability
To the maximum extent permitted by law:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- We shall not be liable for any loss of profits, revenue, data, or business opportunities
- Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim
7. Third-Party Services
We may integrate third-party services including but not limited to hosting providers, domain registrars, CMS platforms, analytics tools, email marketing platforms, and social media tools. We are not liable for any downtime, issues, or failures caused by third-party services.
8. Hosting and Security
Unless otherwise agreed, you are responsible for your own hosting. We are not liable for website downtime caused by hosting providers, security breaches, hacks, or data loss. You are responsible for maintaining secure passwords and access credentials.
9. Updates and Maintenance
After website launch, ongoing updates and maintenance are your responsibility unless otherwise agreed. We are not liable for issues arising from outdated software, plugins, or themes.
10. Termination
Either party may terminate with written notice. Upon termination, you will pay for all work completed up to the termination date. Any deliverables completed will be provided upon full payment.
